1. Rental Policy

This Rental Policy (this ”Renter Policy”), is applicable to each User who is authorized to use the Service, as a Renter in accordance with the Jackrabbit Rentals Terms of Service (the “Terms”) located at jackrabbitrental.com/terms/, which are hereby incorporated by reference, and to lease vehicles shared with Jackrabbit Rentals by an Owner and offered through the Service (each, a “Vehicle”). Capitalized terms that are used in this Rental Policy and not specifically defined in this Rental Policy have the meanings set forth in the Terms. BY UTILIZING THE SERVICE AS A RENTER, YOU SIGNIFY THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY THIS RENTAL POLICY AND THE TERMS AS PART OF A LEGALLY BINDING CONTRACT BETWEEN YOU AND JACKRABBIT RENTALS. PLEASE ENSURE THAT YOU HAVE CAREFULLY READ, CONSIDERED, AND UNDERSTOOD EACH PROVISION AND ITS IMPLICATIONS, BECAUSE THIS RENTAL POLICY INCLUDES IMPORTANT INFORMATION THAT AFFECTS YOUR RIGHTS, REMEDIES, AND OBLIGATIONS IN CONNECTION WITH YOUR ACCESS AND USE OF THE SERVICE AS A RENTER. 

 

Please note that we may modify, supplement, revise, or update this Rental Policy from time to time, for any reason. We will notify you of material changes to this Rental Policy by posting the amended terms on the Service at least 30 days before the effective date of the changes. If you have provided us with your email address, we will notify you of material changes to this Rental Policy by sending an email at least 30 days before the effective date of the changes. You will be subject to, and will be deemed to have been made aware of and accepted, this Rental Policy as modified, supplemented, revised, or updated by your continued use of the Service as a Renter after the effective date of the applicable modifications, supplements, revisions, or updates. If you do not agree to any of the modified, supplemented, revised, or updated terms or conditions, then you should discontinue using and accessing the Service as a Renter.

2. Reservations

When you use the Service to make a reservation for a Vehicle (a “Reservation”), the Service will present you with a page confirming the details of the Reservation. By clicking “I Agree” (or any other means of acceptance presented by the Service), you agree to this Rental Policy and the terms of the applicable Reservation.

3. Personal Use

You may only use the Vehicles for your own personal use and may not lease, ride-share, or otherwise commercialize the use of the Vehicles. You also agree not to use the Vehicles in any unreasonable manner and to operate Vehicles in accordance with applicable laws. Unreasonable uses include drag-racing, competitive driving, driving in extreme or off-road locations, towing any property, or using the Vehicle in any manner that would endanger people or property. You agree to use the Vehicle, and each of its individual components, in the manner for which such component was intended.

4. Location Restrictions

Restrictions on Location The use of each Vehicle is limited to the continental United States for now. As such, you agree to keep the Vehicle, at all times, within the continental United States. You will not drive it across any national border or otherwise allow the Vehicle to be relocated outside of the continental United States.

5. Optional Charges

Renter shall pay Vehicle Owner, its affiliates, or agents on demand as set forth on the Summary of the Contract: (1) The mileage charge per mile for all miles exceeding any free miles set forth on the Summary permitted for the Rental Period. 200 miles allotted per reservation day. Any overage will be charged at US$0.25 per mile over the allotted amount. (2) The Optional Accessories, services and/or products charges for those items accepted by Renter for the Rental Period set forth on the Summary. (3) The charges for the rental of the toll collection transponder, if applicable. The optional Tolltag Service accepted by Renter provides for the daily rental of a toll collection transponder or, in some states or provinces, the use of a pre-installed device or video-monitored toll collection services. In addition to the daily charge for the Tolltag Service, Owner, its affiliate, or a third party may separately charge Renter’s credit or debit card for each toll (or other charge) incurred using the transponder, pre-installed device or video-monitored service during the Rental Period within the Tolltag Service area at the higher of the applicable toll authority’s cash toll rate or highest undiscounted toll rate. Renter expressly authorizes Owner or its affiliate to transfer to a third party: Renter’s name, address, credit/debit card information, and other data necessary to enable the collection of all such amounts. No credit is provided for days the transponder is not utilized. Tolltag Service has a limited service area; attempting to use the service outside the service area may subject the Renter and/or any Approved Driver to fines and penalties. (4) The taxes, fees, and other mandatory charges imposed by states, provinces, counties, and other governmental authorities. Additional Obligations of Renter – Unless prohibited by law, Renter shall pay Jackrabbit Rentals, its affiliates, or agents: (1) If Renter returns Vehicle to a location other than the designated return location, a vehicle recovery fee, unscheduled one-way fee or drop charge which shall be no more than the greater of: A) US$500.00; B) US$2.00 per mile between return location and original rental office; or C) Jackrabbit Rentals’ adjusted daily, weekly or monthly rate applicable on the date of return. (2) A late charge of 5% per month, not to exceed the maximum allowable by law, on all charges not paid within 30 days after the end of the Rental Period. (3) All expenses incurred by Owner in the collection of amounts due Owner under the Contract or in regaining possession of Vehicle or in enforcing any term or condition, including attorneys’ fees, Owner’s administrative fees, impound fees, and any other costs or expenses incurred by Owner. (4) The fee equal to the estimated cost of lost, stolen, or temporarily misplaced keys, key fobs, and transponders. (5) A fee to recharge an Electric Vehicle (Battery Electric or Plug-In Hybrid Electric) if Vehicle is returned with less charge than when rented. (6) RENTER EXPRESSLY AUTHORIZES OWNER OR ITS AFFILIATE TO TRANSFER AND PROVIDE TO ANY THIRD PARTY, WITHOUT NOTICE TO RENTER, RENTER’S NAME, ADDRESS, CREDIT CARD INFORMATION AND ALL OTHER DATA NECESSARY TO PROCESS PAYMENT FOR, ENABLE THE COLLECTION OF, OR TRANSFER LIABILITY FOR ALL AMOUNTS RENTER IS OBLIGATED TO PAY UNDER THIS PARAGRAPH 3.C, INCLUDING, WITHOUT LIMITATION, TOLLS AND ASSOCIATED CHARGES INCURRED DURING THE RENTAL PERIOD, AND ANY FINES, TOLLS, VIOLATIONS, PROCESSING FEES, OR ANY VIOLATIVE ACTION. AGREEMENTS AND ACKNOWLEDGEMENTS REGARDING PAYMENT CARDS: IF A CREDIT CARD OR DEBIT CARD IS PRESENTED AS A MEANS OF PAYMENT, DEPOSIT OR SECURITY, RENTER AUTHORIZES OWNER TO SUBMIT FOR PAYMENT ON SUCH CARD(S) ALL AMOUNTS OWED UNDER The Contract INCLUDING IF ANY THIRD PARTY TO WHOM A BILLING WAS DIRECTED REFUSES TO MAKE PAYMENT. IF OWNER INITIATES ANY CHARGE THAT IS DISHONORED, RENTER AUTHORIZES OWNER TO RE-INITIATE SAID CHARGE WITHOUT FURTHER AUTHORIZATION FROM RENTER. The authorization or deposit amount on the Summary will be taken by Jackrabbit Rentals as an authorization or sale. Such funds will not be available for use by Renter until after Vehicle is returned. One or more incremental authorizations and/or deposits may be taken during the Rental Period if Renter incurs additional charges. Renter acknowledges final amounts charged to Renter’s card may exceed amounts shown on the Summary, if Renter incurs charges not included in such amounts. Jackrabbit Rentals reserves the right, in its sole discretion, to set off or deduct from any amounts owed from Jackrabbit Rentals to Renter under the Contract any amounts owed from Renter to Jackrabbit Rentals under the Contract. Jackrabbit Rentals will attempt to refund Renter any amount collected from Renter that exceeds the aggregate of all of Renter’s obligations to Jackrabbit Rentals within 30 business days after Jackrabbit Rentals has confirmed the full extent of such obligations. Where applicable for payments made by cash, check, or money order, any such excess will be refunded by check. 

6. Treating the Vehicle As If It Was Your Own

You agree to use reasonable standards of care regarding the use and operation of each Vehicle you use through the Service. We expect, and you agree, to keep the Vehicle secure while it is not in operation, to park it in locations that are intended to accept parked vehicles, keep the Vehicle sufficiently fueled while in use, and to otherwise comply with all applicable laws. Upon return, if the car requires more than Jackrabbit Rentals’ standard cleaning, Jackrabbit Rentals may charge you  an additional US$200 cleaning fee.. YOU MAY NOT SMOKE IN A VEHICLE AT ANY TIME. A smoking fee of US$250 will be charged if evidence or smell of smoking is found. We reserve the right, on our own behalf and on behalf of our Owners, to assess penalties, fines, or expenses due to smoking during the use of a Vehicle. You may not make any modifications or changes to the Vehicle, including stickers, window shields, paint, or internal mechanical changes.

7. Authorized Drivers Only

You agree that you have reviewed and meet our Renter Eligibility Requirements as set forth in the Jackrabbit Rentals Terms of Service prior to each Reservation. You understand and agree that, for all purposes of the Service and this Rental Policy, you are the sole authorized driver (“Authorized Driver”) allowed to operate the Vehicle. At no time may any person operate a Vehicle if not listed as an Authorized Driver. You will be responsible for, and will hold Jackrabbit Rentals completely harmless from, any use of the Vehicle by anyone other than an Authorized Driver. You must return the Vehicle at the end of your Reservation in the same condition as when you started your Reservation, ordinary wear and tear excepted. 

 

Additional Authorized Drivers: While the primary renter is recognized as the sole authorized driver under this Rental Policy, we understand the need for flexibility during the rental period. Renters may wish to designate additional drivers who are authorized to operate the rented vehicle. To accommodate this, Jackrabbit Rentals allows the addition of extra drivers to the rental agreement under the following conditions:

 

Process for Adding Additional Drivers: Renters must request the addition of any additional drivers directly through the Jackrabbit Rentals Service, providing the full names and driving license details of the prospective additional drivers for approval. All additional drivers must meet Jackrabbit Rentals’ standard rental eligibility requirements, including age and driving record criteria.

 

Additional Driver Fee: A fee of US$10 per day, per additional driver, will be applied. This fee covers the administrative costs of adding extra drivers to the rental agreement and extends insurance and roadside assistance coverage to all authorized operators of the vehicle.

 

Responsibilities of Additional Drivers: Additional drivers are subject to the same terms and conditions of the Renter Policy as the primary renter. This includes adherence to all use restrictions, liability for damages, and compliance with traffic laws. The primary renter remains responsible for the actions of any additional drivers and any financial obligations arising from their use of the vehicle.

 

Additionally, Jackrabbit Rentals establishes a minimum renter age of 21 years for eligibility to rent a vehicle. Renters under the age of 25 may incur an additional fee and may be subject to restrictions regarding the class of vehicles available for rental. Higher deposits may also be required for certain vehicle classes to accommodate the increased risk associated with younger drivers. These measures are in place to ensure the safety and reliability of our service for all users.

8. Fees, Tolls, Charges

Each Renter will be solely and fully responsible for all charges, expenses, or tolls incurred while using a Vehicle during a Reservation. You agree to promptly and fully, without contest, pay all applicable charges, expenses, or tolls. To the extent you do not do so, or we or an Owner otherwise elects to at any time, we or an Owner may pay applicable charges, expenses, or tolls on your behalf. You hereby authorize us to charge any credit card or payment method on file to reimburse us or such Owner fully for such payment, together with any additional expenses or costs we (or an Owner) incurs by making such payment. All fines, costs, charges, and attorneys’ fees paid or to be paid by Jackrabbit Rentals, its affiliates, or a third party for legal violations, parking, tolls, towing and storage, and the like occurring during the Rental Period (Fines, Tolls, and Violations). Without advance notice, Renter agrees to the payment of all Fines, Tolls, and Violations by Jackrabbit Rentals, its affiliates, or a third party, and that such amounts, plus Processing Fees, may be collected from Renter by Jackrabbit Rentals, its affiliates, or a third party. Renter agrees that such collection is not a transfer of liability where prohibited. Renter agrees that such payment may prejudice, waive, and relinquish (and Renter agrees to waive and relinquish) Renter’s ability and right to contest Fines, Tolls, and Violations and/or any legal violation underlying same (Violative Action) with the applicable authority. Jackrabbit Rentals, its affiliates, or a third party may assess a fee of up to $50 per each of the Fines, Tolls, and Violations (Processing Fees) to apply towards all costs incurred in connection with the Fines, Tolls, and Violations and their administration.

9. Other Fees

(A) Any airport Consolidated Facility Charge, Customer Facility Charge, Airport Transportation Fee or similarly designated charge (CFC) which is required to be paid by us or an Owner or collected from Renter in connection with this rental, for the construction, financing, operation, and/or maintenance of the consolidated rental car facility, other airport facilities, and/or transportation related facilities, and/or any other permissible use of the CFC under relevant federal, state or municipal laws, ordinances, or regulations, and/or relevant agreements, and (B) The Concession Fee Recovery, Concession Fee Recoupment, or similarly designated charge (CONC REC) which is Owner’s charge to recover the concession fees paid by us or by an Owner to an airport’s owner or operator in connection with this rental; and (C) The Facility Fee Recovery (FAC REC) which is a charge by us or an Owner to recover the estimated fees, charges, costs, which may include rent paid by Owner to the owner, operator or agent of the location being serviced by us or by an Owner for this rental or to the owner or operator of the location of the Branch Address on the Summary; and (D) The Vehicle License Fee Recovery (VLF REC) c recover the estimated average daily cost per vehicle of the charges imposed by governmental authorities upon Owner or its affiliates to title, register and plate all vehicles in its/their rental fleet within the state in which the rental originates and ad valorem taxes for the Vehicles. The VLF REC is not calculated based on the costs imposed upon a particular vehicle; and (E) The Airport Pick-up Fee (APUF REC), which is the charge to us or to the Owner, to recover the estimated daily average cost to store vehicles at airport facilities parking locations paid by Owner or it’s affiliates to an airport’s owner, operator or third party operator in connection with this rental.

10. Fueling & Recharging

You agree to return the Vehicle with at least the same amount of fuel in the tank as was present at the start of your Reservation. If the fuel level is not returned to its initial level at the start of your Reservation, you may be charged to remedy the applicable deficiency. A Convenience Fee of $25 may apply in addition to the cost of refueling the vehicle. Fuel charges will not exceed US$10 per gallon, or US$200, whichever is less. You further agree that you are responsible for refueling the Vehicle with the manufacturer-recommended fuel type. Failing to properly fuel the Vehicle will be considered material damage to the Vehicle, and you will be responsible for all damages and expenses arising from the applicable failure. This also includes fully charging any electric vehicle in accordance with any Owner requirements or manufacturer guidelines prior to completing a Reservation. If a rented electric vehicle (EV) is returned with a battery charge below 81%, a recharging fee will be applied based on the following schedule: $50 for 0%-20% charge, $20 for 21%-50% charge, and $10 for 51%-80% charge. No fee will be applied if the battery charge is 81% or higher. These fees are added to the final rental invoice and are due upon vehicle return. By signing the rental agreement, the renter acknowledges and agrees to this recharging fee policy. This policy may be subject to change, and any updates will be communicated accordingly. 11. Maintenance and Wear & Tear Definitions

As a renter, you are not responsible for routine maintenance such as oil changes. Jackrabbit Rentals vehicle owners are tasked with keeping their vehicles in top shape, following manufacturer recommendations. Contact Jackrabbit Rentals at (619) 880-7220 for any operational concerns.

 

Normal wear and tear are minor imperfections that don’t compromise the vehicle’s function or appearance, such as light scratches or interior marks. However, renters will be accountable for any substantial damage, including deep scratches, windshield damage, or significant interior harm, which surpasses normal use expectations.

12. Proper Care

Our business only works when each Vehicle is returned in substantially the same manner as when a Reservation started. This requires that each Renter take certain actions to care for the Vehicles that they reserve and use. As a Renter and at the end of each Reservation when you return a Vehicle, you agree to: remove all personal belongings from the Vehicle, including luggage, cell phones, laptops, backpacks, ski equipment, etc.; remove all disposable trash; wipe down all interior surfaces, shake out floor mats, vacuum up loose pet hair or other dirt remnants; fuel the Vehicle to the same level it had at the start of the Reservation, this also means charging if the Vehicle is electric prior to dropping off at the respective location; if the exterior of the Vehicle is unusually muddy or dirty, driving the Vehicle through an automated automobile wash; and fully inspecting the Vehicle prior to ending the Reservation for any damage that occurred during your use. We reserve the right, on our behalf or any Owner’s behalf, to charge you for any expenses incurred in cleaning any excessively dirty Vehicle. Any failure to adhere to the above cleaning procedures may impact your ability to use the Service in the future.

13. Document All Damage

Before driving a vehicle, you must submit an inspection report, including photos of any pre-existing damage through the Service. You understand and agree that, at our discretion, you may be liable for any damage that you fail to report before driving the Vehicle. 

 

Vehicle Inspection and Return Process: To ensure clarity and fairness for both parties, a detailed vehicle inspection will be conducted at the time of pickup and return. Upon pickup, renters are required to complete an inspection report, documenting any pre-existing damage with photos and descriptions through the Service. This report serves as a baseline for the vehicle’s condition. At the end of the rental period, the vehicle will undergo a return inspection to assess its condition against the initial report. Renters are encouraged to be present during both inspections, to verify the vehicle’s condition.

 

In the event of a dispute regarding vehicle condition or any damages identified upon return that were not documented at pickup, Jackrabbit Rentals will review the inspection reports, photographs, and any other available evidence. Renters will have the opportunity to provide their input and any additional evidence they may have. Disputes will be resolved based on the preponderance of the evidence available. Jackrabbit Rentals is committed to a fair and transparent resolution process, aiming to resolve any disputes efficiently and equitably. Renters are advised to thoroughly document the vehicle’s condition at both pickup and return to avoid any potential disputes.

14. Traffic Tickets and Moving Violations

You understand and agree that you are solely liable for traffic tickets, moving violations, and any other traffic violations that occur during your Reservation, including all resulting fees, expenses, and losses. You authorize Jackrabbit Rentals to correspond with governmental agencies regarding your identity and other personal information if requested due to an alleged violation of law by you.

15. Driving Record

If you incur any traffic incident or driving violation that affects your eligibility as an Authorized Driver on the Service, you agree and understand that you immediately become ineligible and are no longer considered an Authorized Driver.

16. Service Fees

 For every Reservation, you understand and agree that you will be charged a fee as specified when you follow the checkout process for the applicable Reservation. In addition to the amount due, delinquent accounts and/or chargebacks may incur fees or charges that are incurred by us or our representatives in the process of collecting such amounts. If we need to contact you to collect amounts you owe, you authorize us and our representatives, including debt collection agencies, to contact you at any phone number or email address you provide, from which you contact us, or at which we believe we can reach you.

17. Security Deposit

You agree and understand that a one-time deposit, ranging from US$150 to US$750, will be held on your Reservation. This security deposit is intended to cover any potential damages or additional charges incurred during your rental period. Upon the return of your rental, and after the vehicle inspection has been completed, we will initiate the refund of the security hold within 3 – 5 business days.


Note: Depending on your banking institution, it may take up to 5-15 business days for the credit to appear on your account. This timeframe is a standard banking procedure and is outside of Jackrabbit Rentals’ control. We strive to process all refunds promptly and appreciate your understanding regarding any delays that may occur due to banking processes.

18. Cancellations and No Show Policy

  1. Cancellations: Reservations can be canceled at no cost up to 24 hours before the reservation start time. Cancellations made less than 24 hours before the reservation start time will incur a cancellation fee, as well as a charge of 50% of the total reservation cost. Your primary credit card on file with the Service will be charged accordingly. Any security deposits paid will be fully refunded in the event of a cancellation, regardless of timing.


    No Show Policy: If you fail to pick up the vehicle at the reserved time without any prior notification (referred to as a “No Show”), you will forfeit 100% of the reservation cost. In such instances, the security deposit will be refunded to your original payment method. This policy is in place to ensure that vehicles are efficiently utilized and available to all users of the Service.


    It is your responsibility to ensure that any cancellations are communicated through the Service’s designated channels to be processed effectively. We encourage all renters to inform us of any changes to their plans as early as possible to avoid unnecessary charges and to allow for the vehicle to be available for rental by other users.

19. Late Returns and Legal Consequences

  1. By agreeing to this policy, you acknowledge and accept the following terms regarding late returns of a rented vehicle:

     

    Late Return Fees: Returning a vehicle later than the end time specified in your reservation (or proper extension not paid in full) will incur additional charges. These fees compensate for the inconvenience and potential scheduling conflicts caused by the delay.

     

    Cost Recovery for Overdue Returns: Should the vehicle not be returned by the end of the reservation period, you will be responsible for all associated costs, including but not limited to towing, impoundment, storage, citations, and any recovery fees. These charges reflect the expenses incurred by Jackrabbit Rentals to secure and retrieve the vehicle due to the overdue return.

     

    Reporting of Stolen Vehicle: If a vehicle is not returned within 12 hours following the scheduled reservation end, Jackrabbit Rentals reserves the right to consider the vehicle stolen and may report it to law enforcement authorities accordingly. This measure is a last resort to ensure the recovery of the vehicle and protect our assets.

     

    Legal Implications: The failure to return a rented vehicle as agreed can lead to serious legal consequences. If the vehicle is reported as stolen, you may face criminal charges, including but not limited to charges of auto theft. Such actions are intended to underscore the seriousness of abiding by rental agreements and the legal obligations of renters.

     

    Responsibility for Actions: You are fully responsible for understanding and complying with the rental agreement terms, including the timely return of the vehicle. It is in your interest to communicate promptly with Jackrabbit Rentals if you anticipate any delays in returning the vehicle to avoid or minimize additional charges and legal complications.

     

    Jackrabbit Rentals encourages all renters to plan accordingly and return vehicles on time. Should unforeseen circumstances arise, please contact us immediately to discuss potential accommodations. Our goal is to work with our customers to ensure a positive rental experience while maintaining the integrity of our service and fleet.

20. Service Violations

  1. You agree that any violations of this Rental Policy from actions taken by you may result in costs charged to your account, at our sole discretion, to recover all resulting and administrative costs.

21. Roadside Assistance

  1. We may provide roadside assistance for accidents and breakdowns that occur during a Reservation. If roadside assistance is not available during a Reservation for any reason, or if your own negligence contributes to the breakdown or need for roadside assistance, you understand and agree that you are solely responsible for all roadside assistance costs, including all resulting costs such as towing, impound, retrieval, and administrative charges, and that you may be subject to additional charges. If you reject the roadside assistance provided by Jackrabbit Rentals and instead utilize a road assistance provider of your choice, you shall indemnify Jackrabbit Rentals from any and all claims arising out of your rejection of Jackrabbit Rentals’ roadside assistance. In the case of a mechanical breakdown of a Vehicle not caused by your negligence or failure to comply with this Rental Policy, Jackrabbit Rentals will attempt to transfer your reservation to a nearby available Vehicle. If there are no available Vehicles nearby, Jackrabbit Rentals’ responsibility in such a situation is limited to the portion of the Reservation price paid by the Renter that is attributable to the unused part of the Reservation. If there are no available Vehicles nearby, Jackrabbit Rentals may, in its sole discretion, reimburse the Renter for reasonable expenses incurred directly by the Renter and required to transport the Renter and any affected passenger(s) to a safe location within 25 miles of the site of the breakdown.

22. Location Risk

  1. You are solely responsible for assessing the safety of any location where you elect to drive or park a Vehicle, and you assume all associated risk. You acknowledge and agree that Jackrabbit Rentals shall not be responsible for any damage to the Vehicle, any stolen personal property, any personal injury or death arising from your use of a Vehicle, including, without limitation, if such damage, stolen personal property, or personal injury or death occurs during a Vehicle breakdown or due to a mechanical failure.

23. Hands-Free Usage

  1. Prohibited Notwithstanding the presence of any form of assisted driving or autopilot aid, Vehicles must be driven with at least one hand holding the steering wheel at all times while in motion unless such operation is prevented by a physical disability as defined by applicable state or federal law.

24. Renter and Owner Direct Arrangements

  1. Jackrabbit Rentals does not recognize or enforce agreements or arrangements made directly between Renters and Owners outside of the Service, and Renters engage in direct arrangements with Owners at their sole risk, notwithstanding whether any applicable arrangements relate to a Reservation made through the Service.

25. Damage Waiver

  1. Damage waiver (DW) ranges between US$9.00 and US$20.00 per day, depending on the type of waiver selected. DW is offered at the time of booking the rental for an additional daily charge. If the renter accepts DW, Jackrabbit Rentals waives or reduces the renter’s out-of-pocket responsibility for loss of, or damage to, the rental vehicle, including but not limited to towing, storage, loss of use, administrative fees and-or diminishment of value subject to the terms and conditions of the rental agreement and applicable laws. DW is not insurance; it is optional coverage for Renters and Approved Drivers to offset a portion of their out-of-pocket insurance deductible costs on their personal insurance policy in the event damage or loss occurs while the vehicle is in the Renter’s possession. The purchase of DW is optional and not required to rent a car. The protection provided by DW may duplicate the renter’s existing coverage. Jackrabbit Rentals is not qualified to evaluate the adequacy of the renter’s existing coverage therefore, the renter should examine his or her credit card protections, automobile insurance policies, or other sources of coverage that may duplicate the protection provided by DW.

26. Detailed Coverage Limits

  1. Jackrabbit Rentals provides an array of protection plans for renters, each designed to offer varying levels of coverage for damages and liabilities incurred during the rental period. These plans are outlined as follows, with each offering specific financial protections against potential vehicle damage or theft, along with state-mandated minimum liability insurance. The aim is to furnish renters with options that cater to their individual risk preferences and budgetary considerations while ensuring compliance with legal insurance requirements.

     

    Standard Protection (Mandatory):

    $3,000 maximum out-of-pocket expense for damage or theft

    State minimum liability insurance

    Cost: $8/day



    Premier Protection:

    $1,000 maximum out-of-pocket expense for damage or theft

    State minimum liability insurance

    Cost: $9/day



    Platinum Protection:

    No out-of-pocket expense for damage to the vehicle or theft

    State minimum liability insurance

    Cost: $19/day

27. Insurance Claims and Reporting Procedures Insurance Coverage

  1. During your Reservation, your vehicle is covered by your personal insurance policy. You agree that you have reviewed the Jackrabbit Rentals Terms of Service and are aware that we require all Renters to carry their own personal vehicle insurance policy that offers automobile protection against comprehensive, collision, and liability damages. Jackrabbit Rentals is not qualified to evaluate the adequacy of the renters existing coverage therefore, the renter should examine his or her credit card protections, automobile insurance policies, or other sources of coverage that may duplicate the protection provided. Jackrabbit Rentals and Owners are not responsible for any property or liability damage incurred during your Reservation. Jackrabbit Rentals, VEHICLE OWNERS, AND RENTER REJECT UM/UIM COVERAGE TO THE EXTENT PERMITTED BY LAW. All coverage, including UM/UIM benefits, is provided by Renters personal insurance only when Renter or any approved drivers are driving the Vehicle. No claim for UM/UIM may be made due to the negligence of the driver of the Vehicle. Coverage is in effect only while the Renter or Additional Driver is driving the Vehicle within the United States; coverage does not apply in Mexico. Jackrabbit Rentals AND VEHICLE OWNERS POLICY EXCLUSIONS INCLUDE: (A) BODILY INJURY OR DEATH TO RENTER, ANY APPROVED DRIVER, OR TO THE BLOOD RELATIVES OR FAMILY OF RENTER OR AN APPROVED DRIVER, IF SUCH RELATIVES OR FAMILY RESIDE IN THE SAME HOUSEHOLD WITH RENTER OR WITH AN APPROVED DRIVER; (B) PROPERTY DAMAGE TO THE RENTAL VEHICLE; (C) FINES, PENALTIES, EXEMPLARY OR PUNITIVE DAMAGES; (D) BODILY INJURY, DEATH OR PROPERTY DAMAGE EXPECTED OR INTENDED FROM THE STANDPOINT OF THE INSURED; AND (E) ANY OBLIGATION FOR WHICH THE INSURED OR THE INSURED’S INSURER MAY BE HELD LIABLE UNDER ANY WORKER’S COMPENSATION, DISABILITY BENEFITS OR UNEMPLOYMENT COMPENSATION LAW OR ANY SIMILAR LAW. (F) BODILY INJURY OR PROPERTY DAMAGE EXPECTED OR INTENDED FROM THE STANDPOINT OF RENTER OR APPROVED DRIVER. Filing a Claim. If a Vehicle is damaged during your Reservation, it is your responsibility to gather relevant information and report the damage and related circumstances to Jackrabbit Rentals & police in the jurisdiction within 24 hours of the incident. You understand and agree to report damage to Jackrabbit Rentals online no later than 24 hours after the end of the incident unless you are rendered incapable of doing so. You understand and agree to detail the full nature of the damage and allow time for damage or loss assessment, dispute arbitration, or remediation at Jackrabbit Rentals’ sole discretion. You understand and agree that failing to report damage within 24 hours of the incident and you will be solely responsible for all repairs and any loss or liability arising from the incident. Damage Fee.  If you have accepted the optional partial damage waiver (“dw”), which is not insurance and which is not available for all rentals, Jackrabbit Rentals will not hold you responsible for loss of or damage to the car, except as described in ’26’, up to an amount equal to the lesser of $1,000 and any deductible under your own automobile insurance that applies to the damages sustained by the car. if you accept dw, your insurer will be billed for the full amount of the loss; only the applicable deductible under your policy (up to $3,000) is waived after the loss is paid. At the conclusion of the claim, a part of or the full Damage Fee may be returned to you should the loss amount not exceed the full Damage Fee or if another party is deemed responsible for the loss. Negligence, Misuse, or Breach. You understand that any negligence, misuse, or breach of this Rental Policy or the Jackrabbit Rentals Terms of Service may void your insurance coverage and that you will be solely liable for any damage, liability, or loss arising from your actions. Damage Assessment. You understand and agree that, in assessing any damage or loss, we will utilize the services of a professional vendor approved by Jackrabbit Rentals at our sole discretion or an approved vendor selected by insurance provider representing the liable party.

28. Accident And Damage Instructions

  1. Protocol for Collision with Another Vehicle:

     

    1. Ensure everyone’s safety and check for injuries; call emergency services if needed.
    2. Do not leave the scene and set up warning signals for other drivers if possible.
    3. Exchange contact and insurance information with the other driver(s).
    4. Document the scene with photos, including all vehicles involved, license plates, and the surrounding area.
    5. Contact Jackrabbit Rentals to report the collision and follow their instructions for documentation and next steps. Email photos of the accident to [email protected] as soon as possible. Please include your name, contact number, and reservation ID (optional).

     

    Protocol for Other Types of Damage (Non-Collision):

     

    1. Document the damage with clear photos and note any circumstances that may have contributed to it.
    2. If damage is discovered during vehicle pick-up, report it to Jackrabbit Rentals before driving off.
    3. If damage occurs during the rental period (e.g., vandalism, weather damage), report it to Jackrabbit Rentals as soon as possible.
    4. Follow Jackrabbit Rentals’ instructions for documenting the damage and cooperate with any required procedures. Email photos of the accident to [email protected] as soon as possible. Please include your name, contact number, and reservation ID (optional).

     

    In both cases, refer to Jackrabbit Rentals’ terms for specific details on reporting timelines and insurance processes.

29. Emergency Procedures

  1. Understanding the correct actions to take in the event of an emergency is crucial for the safety of all parties involved. In the unfortunate circumstance of an accident resulting in bodily injury or significant vehicle damage, renters should follow these immediate steps:

     

    Ensure Safety: Prioritize the safety of all individuals involved. Move to a safe location if possible and check for injuries. Call emergency services immediately if there are any injuries or if there is a significant threat to safety.

     

    Report the Incident: As soon as it is safe to do so, report the accident to the local authorities by calling 911 or the appropriate emergency number. Obtaining a police report can be vital for insurance and damage claims.

     

    Document the Scene: Take photographs of the vehicle, any other vehicles involved, and the surrounding area. Documenting the scene can provide essential information for insurance claims and accident reports.

     

    Exchange Information: Exchange contact and insurance information with any other parties involved in the accident. This includes names, addresses, phone numbers, driver’s license numbers, and insurance policy details.

     

    Notify Jackrabbit Rentals: Contact Jackrabbit Rentals as soon as possible to report the incident. Provide all relevant information and documentation, including the police report number, photographs, and any other details of the accident.

     

    Follow Jackrabbit Rentals Instructions: Jackrabbit Rentals will provide specific instructions on how to proceed, including how to handle the vehicle and any necessary steps for insurance claims or vehicle recovery.

30. Lost and Found Policy

  1. You acknowledge that Jackrabbit Rentals is not responsible for any personal belongings or items left in the rented vehicle by you or any passengers. You agree that any items found in the vehicle after the rental period expires shall be deemed abandoned and may be disposed of by Jackrabbit Rentals at its discretion. Jackrabbit Rentals shall not be liable for any loss or damage to personal belongings or items left in the vehicle.

     

    In the event that you discover you have left personal belongings or items in the rented vehicle, you should contact Jackrabbit Rentals immediately at [email protected] or (619) 880 – 7220 to inquire about the lost item. While Jackrabbit Rentals will make reasonable efforts to locate and return lost items, it does not guarantee the retrieval of lost items nor accept any liability for their loss.

     

    By signing this Rental Agreement, you acknowledge and agree to the terms outlined in this “Lost and Found” section and release Jackrabbit Rentals from any liability regarding lost items left in the rented vehicle.

31. Electronic Signature Policy

  1. By using an electronic signature to sign this Rental Agreement, or clicking “I Agree” on our Service, you consent to the legally binding nature of your electronic signature in accordance with the Electronic Signatures in Global and National Commerce Act (“E-SIGN”), Uniform Electronic Transactions Act (“UETA”), and other applicable laws. Your electronic signature on agreements and documents holds the same weight as if you signed them in ink.

     

    Electronic Communications: You agree to receive all rental-related communications electronically, which satisfies any legal requirement that such communications be in writing. You are responsible for maintaining a current email address and for reading notices sent electronically.

     

    System Requirements: To engage in our electronic transactions and to retain copies, you need internet access, an up-to-date browser, an active email, and the ability to store or print communications.

     

    Withdrawing Consent: You may withdraw your consent to electronic agreements; however, doing so will terminate your use of the Service. To withdraw, contact us directly.

     

    Contact Updates: Keep your contact details current to ensure uninterrupted electronic communication.

     

    This policy outlines your agreement to conduct transactions and receive notices electronically, streamlining our rental process.

32. Acknowledgment of Risk, Agreement Modification, and Severability

  1. Acknowledgment of Risk: Renters acknowledge the inherent risks associated with the operation and rental of a vehicle, including but not limited to the potential for personal injury, property damage, and loss. Renters agree to assume all such risks, both known and unknown, relating to their rental and use of Jackrabbit Rentals vehicles.

     

    Modification of Agreement: This Rental Guest Policy, including any future modifications, supplements, revisions, or updates, constitutes the entire agreement between you (the renter) and Jackrabbit Rentals regarding your rental. Changes to this agreement may be made only through a written amendment signed by both parties or, if applicable, by a unilateral update of this policy by Jackrabbit Rentals accompanied by notice to you as previously described. Your continued use of the Service following any modifications signifies your acceptance of those changes.

     

    Severability: If any provision of this agreement is found to be invalid or unenforceable, such finding does not affect the validity of the remaining provisions, which shall remain in full force and effect. The parties agree to replace any invalid or unenforceable provision with a valid and enforceable provision that most closely matches the intent of the original provision.
